46वें संविधान संशोधन, 2002 में मौलिक अधिकार के रुप में चौदह साल तक के सभी बच्चों को मुफ्त और अनिवार्य शिक्षा देने का नियम है। शिक्षा का अधिकार (आरटीआई एक्ट) संविधान के 21अ में जोड़ा गया है। यह 1 अप्रैल, 2010 से प्रभावी है। आरटीआई एक्ट में निम्न बातें बतायी गयीं हैं।
इस विधान के अनुसार अब किसी भी सरकारी विद्यालयों में बच्चों को मुफ्त और अनिवार्य शिक्षा देने का प्रावधान है। शिक्षा का अधिकार कानून विद्यार्थी-शिक्षक-अनुपात (प्रति शिक्षक बच्चों की संख्या), कक्षाओं, लड़कियों और लड़कों के लिए अलग शौचालय, पीने के पानी की सुविधा, स्कूल-कार्य दिवसों की संख्या, शिक्षकों के काम के घंटे से संबंधित मानदंड और मानक देता है।
भारत में प्रत्येक प्राथमिक विद्यालय (प्राथमिक विद्यालय + मध्य विद्यालय) को शिक्षा के अधिकार अधिनियम द्वारा निर्धारित न्यूनतम मानक बनाए रखने के लिए इन मानदंडों का पालन करना है। जो बच्चे किसी कारणवश उचित समय पर विद्यालय नहीं जा पाते, उन्हें भी उचित कक्षा में प्रवेश देने का नियम है। साथ ही यह प्रशिक्षित शिक्षकों की नियुक्ति भी करता है।
यह संविधान में उल्लेख किए गये मूल्यों के हिसाब से पाठ्यक्रम के विकास के लिए प्रावधान करता है। और बच्चे के समग्र विकास, बच्चे के ज्ञान, सम्भावना और प्रतिभा निखारने तथा बच्चे की मित्रवत प्रणाली एवं बच्चा केन्द्रित ज्ञान प्रणाली के द्वारा बच्चे को डर, चोट और चिंता से मुक्त करने को संकल्पबध्द है।
